1. General

Under these conditions, the Company (ROTA) agree to supply you (the Customer) with the goods shown in the schedule.

Should the customer change the details of the order and the Company has commenced the manufacturing process, the Company reserves the right to make a charge for reasonable costs involved.

The information contained on this website is for general guidance only. The Company makes every effort to ensure that the information and advice on this website is accurate, it is not comprehensive. Accordingly, the information and advice offered on this website should not be relied upon, and expert advice should be sought from an appropriate professional.

The Company reserves the right to change or update any website content, prices or products at any time without prior notice.

Imagery used on the website is for illustrative purposes only. The colour and appearance of actual products may differ from those items shown on this website. All images, descriptive matter, specifications and advertising on our site are for the sole purpose of giving an approximate description of the goods. Full detailed specifications are available from the Company. All information the website should be as accurate and up to date as possible. However, the Company cannot guarantee the reliability or the accuracy of the information contained within its pages. All the actions taken by the user of the website are the responsibility of the individual.

All prices are subject to change without prior notice.

We are under no obligation to provide the product to you at the incorrect (lower) price, even after we have sent you an order confirmation e-mail.


2. Ordering

All dimensions are to be supplied in Metric and all designs are viewed as from INSIDE. Any sizes given should include the frame, cill and any frame extenders/add on’s required.

Upon receipt of your order and payment, confirmation will be emailed or posted to the customer for checking.


3. Payment

All goods ordered must be paid for in full prior to manufacturing.

We accept all major credit and debit cards including Visa, Mastercard, Maestro & Solo. On the order you must provide us with your exact billing address and telephone number - the address and phone number your credit card bank has on file for you. Incorrect information will cause a delay in processing your order. Your order will only be processed once authorisation of your card has been properly received.


4. Changing Order

Where possible you will have 24 hours from the time you placed the order in which to make any changes or amendments, the exception to this is short lead time products which once ordered will be released straight into production and therefore cannot be changed.
Please note that order cancellation is not possible for order that has been dispatched. Should the cancellation is compulsory, the request will be treated as Return. A cancellation penalty charge will be levied which is up to 70% of your purchase amount and shipping fee is non-refundable.


5. Refunds

Customers have the right to return products within 14 days of receiving their order, without giving any reason, under the Consumer Contracts Regulations. Returned items must be in their original condition, unused, and in the original packaging.

To initiate a return, customers must contact our customer service team at info[@]windowsround.co.uk within 14 days of receiving the order. Please provide the order number and reason for return.

Customers are responsible for the cost of returning the items unless the item is faulty or not as described. We recommend using a trackable shipping service or purchasing shipping insurance. We cannot guarantee receipt of returned items.

Customers returning items from the United Kingdom must clearly mark the package as "RETURNED GOODS" to avoid customs charges. We are not responsible for any customs fees or duties incurred on returns.

Once we receive and inspect the returned item, will refund to the original method of payment within 14 days of receiving the returned item. Items not in their original condition, damaged, or missing parts for reasons not due to our error may only be eligible for a partial refund or may be rejected.

If an item is received faulty or incorrect, customers must notify us within 14 days of receipt at info[@]windowsround.co.uk. We will provide instructions for returning the faulty or incorrect item. Customers can choose a replacement, repair, or full refund.

Order cancellation requests are only accepted by email or in writing. Any orders cancelled after 24 hours from order and if your order has been released into production will be subject will be subject to up to 70% of your purchase amount charge to cover parts, materials and labour costs.


6. Delivery

All quoted delivery dates and times are estimates and although we will try our best to meet them we will not be responsible if we are unable to do so.

We strongly recommend that you do not book fitters or trades persons until your order has been delivered and checked by you. We cannot be held responsible for any third-party costs or charges which you incur due to non-delivery of an order, or orders that have not been checked on delivery.

The Company will do all it reasonably can to meet the delivery period advised to you. In the case of unforeseen circumstances beyond our reasonable controls such as weather, traffic or machinery and vehicle breakdown, we shall contact you and agree an alternative date. We will try our best to meet the outlined delivery schedule but shall not be responsible for any failure to deliver ordered products within these stated time frames.

If we can’t deliver because you’re out or we can’t deliver to the curbside, we may charge for redelivery. You don’t have to be present at time of delivery: however, we would require permission to deliver in your absence.

If an item is defective or damaged before or on delivery, we will replace it free of charge. This is in addition to your manufacturer's guarantee.

It is your responsibility to sign for the correct number of items as shown on the delivery consignment note. Any shortages must be notified to us within 48 hours from delivery or within a reasonable amount of time. It is your responsibility to notify us of any incorrect goods supplied within 48 hours from delivery or within a reasonable amount of time. We will not accept liability for goods lost in transit unless we are notified within 48 hours from the expected delivery date or within a reasonable amount of time.

Risk in the goods sold passes to you on delivery, whether or not a signature of receipt has been obtained.

Due to insurance guidelines, delivery personnel are unable to enter private residences. The recipient of the goods is responsible for any additional lifting once the initial delivery has been made.

We recommend that you do not book fitters until your order has been received and checked.


7. Guarantee

The performance and quality of all profiles, glass & panel units are guaranteed for 5 years, hardware and locks 1 year from the date of delivery. We guarantee that the colour for a woodgrain finish will not fade for 10 years providing you regularly wash the product with warm soapy water. Do not try to clean the products with solutions containing bleach or abrasive cleaners.

The Company shall replace any item free of charge proven to be faulty.

Our guarantee does not apply to any defects in the goods caused by:

  • Normal wear and tear;
  • Deliberate damage and/or misuse of the goods;
  • Accidental damage;
  • Failure to use the goods in accordance with their instructions;
  • The alteration or repair of the goods by the customer or any third party that is not authorised by the company;
  • Incorrect installation of the product;
  • Accidental damage or misuse during installation;
  • Use of third-party accessories that are not compatible with the window fixture.

For purchases made by a Customer who qualifies as a Professional, the legal warranty provided for by the Civil Code shall apply. The Professional must, under penalty of forfeiture, report to the Company any defect in conformity of the purchased Item within 8 (eight) days from the discovery. The legal warranty is valid for a maximum period of 12 (twelve) months from the delivery of the Item.

The warranty can only be claimed and will only be valid upon presentation of the sales invoice issued by the Company following the purchase of the window fixtures.


8. Communications and Complaints

Written communications addressed to the Company and any complaints shall be considered valid only if submitted to the Company's E-Commerce Customer Service through the appropriate form available on the website under the "Contact Us" section, or via email at info[@]windowsround.co.uk.

The Company shall respond using the telephone number, email address, or postal address provided by the Customer during registration and/or at the time of purchase, unless otherwise requested by the Customer.


9. Applicable Law

All contracts concluded through this website are governed by Polish law. However, if you are a UK-based consumer, you will not be deprived of the protection granted to you by the mandatory provisions of the consumer protection law applicable in the United Kingdom. Any disputes may be subject to the jurisdiction of the courts of Poland, unless otherwise provided by applicable consumer protection regulations.

Pursuant to Article 14 of Regulation (EU) No. 524/2013, Customers are hereby informed that the European Commission has established an online platform for the alternative resolution of disputes, accessible at the following address: https://ec.europa.eu/consumers/odr. This platform serves as a single point of access for Consumers and professionals seeking to resolve disputes arising from online sales or service contracts through out-of-court proceedings.

The Company is neither obliged nor declares itself willing to participate in alternative dispute resolution procedures before consumer conciliation bodies.


10. Installation

We recommend that a competent or qualified person carries out the installation of goods supplied.

It is well recognised that over 90% of remedial work is due to incorrect installation. Always check the size of your new framework against your old frame before removing old frame.

It is your responsibility to choose the appropriate product based upon the information contained on our web site. If you are in any doubt as to which product to order then contact us. A product cannot be returned when it is subsequently found to be unsuitable for any reason, such as (but no limited to):

- the dimensions of the product are too large/small to fit in the intended opening.

- the product is in poor working order due to improper handling.

- the product is no longer required.


11. Glass visual quality standards

It is important to check your glass before any rendering, plastering or other works adjacent to the glass takes place and as early as reasonably practical. Standing 2 meters away (3m for toughened, laminated and coated glass) or as far as you can if 2 meters is not possible, look directly through the glass not at it in natural light but not direct sunlight with no visible moisture on the surface of the glass at a 90° Angle to the window. It is acceptable to see bubbles/ blisters, fine scratches not more than 25mm long or minute particles providing they are neither obtrusive nor bunched; smears, finger prints, material, dirt are not acceptable. Toughened glass due to the process of toughening may show some visual distortions this will not affect the window performance and Laminated glass is made up of several layers so may have a few more blemished than clear flat glass. Low emissivity coating can in some conditions look like the glass is hazed or cloudy this is normal.

Patterned glass is manufactured differently so the above does not apply.


12. Planning permission

It is your responsibility to find out if you need planning permission or building regulations approval for the goods. We will not be liable for any costs, expenses, loss, or claims for compensation or any other liability arising directly or indirectly as a result of you not getting planning permission or building regulations approval.
